Caroline Cartwright of England has been sentenced to 12 months in prison if, during her eight week suspension, she continues to disturb her neighbors, or anyone in England, while having sex.In April last year, the court issued Cartwright an Anti-Social Behaviour Order, or ASBO, and fined her over £500. Cartwright closed her windows, moved the bed away from the wall, and had sex in the morning, rather than at night. Her husband would sometimes stifle her screams with pillows. Still, recording equipment installed by environmental health officials in a neighbor’s house showed her moans to reach 47 decibels. The World Health Organization marks 30 dB(A) as enough to cause sleep disturbance. Both neighbors and Cartwright note that these are not “quickies.” Previously, the noise lasted from 12:00-3:00 a.m. The vocalizations have since shifted to 6:30-9:00 a.m. The shouts often seem painful, and have brought forth calls reporting suspected domestic abuse. Eventually, Cartwright’s case went to trial by jury.
Margery Ball, partially deaf, claims to not have had a good night’s sleep in two years. Rachel O’Connor testified that being kept awake most the night caused her to repeatedly show up late for work, oversleeping so often. Cartwright claims to have tried to keep the noise from bothering others, but will not stop moaning. “I’m not going to stop. I’ve been making the same noises since the ASBO was imposed, and this morning, we were making noises for three hours. I can’t stop making noise during sex, it’s unnatural to not make any noises, and I don’t think that I’m particularly loud.” She claims the ASBO violates her human rights. Judge Beatrice Bolton disagrees. “I've heard a very short extract of the noise you make and can well see that your neighbours would be upset and distressed by this. The difficulty here is that the first occurrence was the day following the order. Then three days later you breached it again.
