The Human Rights Tribunal of Ontario voted to allow transgender individuals who are arrested to choose the gender of the searching officer if and when they are strip searched. This became an issue when Rosalyn Forrester, a transgender man in the process of undergoing surgery to become a woman, was strip searched by a male officer after requesting a female officer.
The Tribunal ruled that this was unintentional discrimination on the basis of sex. Transgender individuals now have the option to be searched by a male officer, a female officer, or both. It was ruled that officers could not make the decision to refuse to search transgender individuals.
The ruling was issued to support transgender individuals as complete, equal and respected members of society.
