In Alabama, “anti-obscenity” laws are stopping retailers like Sherri Williams from selling sex toys to residents. In a legal battle that has been ongoing since 1998, Williams is taking the next step to reverse the ban on selling sex toys as she attempts to take her case before the Supreme Court.
Williams made a similar attempt in 2005 when the court declined to take the case. Now, Williams has filed an appeal to have the case heard so she may battle against ban that was last supported by the 11 th U.S. Circuit Court of Appeals this past Valentine's Day. The court said the ban was considered constitutional because it is “the state's interest in preserving and promoting public morality...”
Williams argues that the ban oversteps the boundaries of an individual's right to sexual privacy. The ban, which is also in place in Texas and Georgia, only applies the restriction to the sale of sex toys but does not ban possession of them.
